Terms and conditions of registration for short courses and micro-credentials , Ngā kōrero mō ngā ako popoto me ngā kōkuhu-iti

General

  1. In submitting the Registration Form to Massey University for Your choice of Short Course or Micro-credential You:

(a) promise Massey University that You meet the entry criteria for the Short Course or Micro-credential as published by Massey University; and

(b) If You have registered for a Short Course or Micro-credential as an individual, agree to ensure that Massey University receives the prescribed fee as applicable for the Short Course or Micro-credential before the due date; and

(c) agree that your registration in the Short Course or Micro-credential is conditional on Massey University receiving payment in full of all fee arrears (if any) in respect of any prior study at Massey University on or before the due date; and

(d) agree that any teaching materials, books and/or articles supplied by Massey University are only available for Your use for the Short Course or Micro-credential and copying them is an infringement of copyright; and

(e) agree that successful completion of the Short Course or Micro-credential by You does not of itself lead to a qualification on the New Zealand Qualifications and Credentials Framework; and

(f) agree, that You are not relying on any statement that the Short Course or Micro-credential is fit for any particular purpose unless Massey University has recorded that purpose to You in writing; and

(g) agree that, except as expressly stated in these Terms and Conditions and Declaration, nothing else shall be incorporated into the contractual relationship between You and Massey University; and

(h) agree that if You are studying at secondary school in New Zealand You will, if requested by Massey University, produce the written consent of Your school Principal to participate in the Massey University Short Course or Micro-credential; and

(i) agree that Your participation in a Short Course or Micro-credential does not constitute admission to Massey University.

Relevant university regulations, codes, procedures and policies

2.1 If the University confirms Your registration for the Short Course or Micro-credential then You agree that You have all the rights and will observe all of the obligations of “Students” in the:

• Code of Student Conduct
• Student Discipline Regulations
• Relevant Health and Safety Policies
• Library Regulations
• Student Grievance Procedure

2.2 Copies of the Regulations, are available in the Massey University online Calendar

2.3 You agree that You accept the jurisdiction of Massey University in all matters concerning academic progress and discipline.

Health and safety

3.1 While participating in any Short Course or Micro-credential (wherever that is) You must take reasonable care for Your own health and safety, take reasonable care that Your acts or omissions do not adversely affect the health and safety of other people, and You must comply with Massey University instructions on health and safety.

3.2 You acknowledge that there may be hazards while participating in the Short Course or Micro-credential activities and to the extent permitted by law You participate in those activities at Your own risk.

Massey University Rights

4.1 In submitting Your registration for a Short Course or Micro-credential You acknowledge that Massey University reserves the right to do any one or more of the following:

(a) cancel or defer your registration for the Short Course or Micro-credential because courses are oversubscribed or undersubscribed, or as permitted by law, or payment of the Prescribed Fee and any course costs have not been received by Massey University by the due date;

(b) defer the start date or cancel the Short Course or Micro-credential even if You have already registered;

(c) remove You from Short Course or Micro-credential participation (including removing you from any campus) if Your conduct is suspected to be in breach of the Code of Student Conduct or Health and Safety requirements.

4.2 If Massey University exercises any one or more of the rights in clause 4.1 no compensation will be payable to You. Full or partial refund of fees may be given under 4.1 (a) or (b).

Limitation of liability

5.1 Important: Liability of Massey University for any failure by Massey University is excluded where that failure has been caused by circumstances beyond the control of Massey University.

If liability of Massey University is not excluded, You also agree that Massey University’s total liability to You, inclusive of any refund, is limited to an amount equal to twice the Prescribed Fee for the Short Course or Micro-credential in question.

Withdrawals and refunds

6.1 If You have registered for a Short Course or Micro-credential as part of a sponsored group, a separate agreement will be formed between Massey University and the sponsor which applies to withdrawals and refunds.

6.2 If You have registered for a Short Course or Micro-credential as an individual then:

(a) You acknowledge that You may only withdraw from the Short Course or Micro-credential by Massey University receiving written notice from You of Your withdrawal (“Withdrawal Notice”). Non-participation does not constitute notice of withdrawal.

(b) If Massey University receives Your Withdrawal Notice:

(i) within five (5) working days or less before the Short Course or Micro-credential start date Short Course or Micro-credential then Massey University will grant You a partial refund comprising the Prescribed Fee less a sum equal to 15% of the Prescribed Fee comprising an Administration Fee; and

(ii) more than five (5) working days before the relevant Short Course or Micro-credential start date Massey University will grant you a full refund.

(c) At the time of Your Withdrawal Notice You may elect not to receive a full or partial refund but to transfer the Prescribed Fee received by Massey University to another Short Course or Micro-credential provided by Massey University.

(d) The date of Your withdrawal is the date that Massey University records as receiving Your Withdrawal Notice. “Prescribed Fee” means that fee for the Short Course or Micro-credential specified by Massey University and does not include course costs where these are separately stated. There are no refunds for course costs when these are not included in the Prescribed Fee.

6.3 If You are a learner who has registered for a Short Course or Micro-credential then Massey University will grant you full a refund if:

(i) you are an international learner and you have been unable to secure an applicable visa and you have notified Massey University before the course start date; and

(ii) for any reason Massey University ceases to be a signatory to the Education (Pastoral Care of Tertiary and International Learners) Code of Practice 2021; and

(iii) for any reason Massey University ceases to be a tertiary provider.

Information required

7.1 If You are:

(i) an international learner registering for a Short Course or Micro-credential You must produce evidence satisfactory to Massey University of Your identity and citizenship and any applicable visa; or

(ii) A domestic learner registering for a Micro-credential You must produce evidence satisfactory to Massey University of Your identity;

(iii) A domestic or international learner registering for a Short Course or Micro-credential and you are under 18 years of age when the course commences You must provide you must provide a completed Authority and Agreement for Applicant Under 18 Years Old form.

Acceptance of registration

8.1 If You are accepted by Massey University on the Short Course or Micro-credential, this constitutes registration in the Short Course or Micro-credential. If the conditions in this document are not met, Massey University may, at its option by notice in writing, end your registration in the Short Course or Micro-credential.

8.2 If You are accepted by Massey University on the Short Course or Micro-credential You will have the rights and obligations of learners specified in the Education and Training Act 2020, and in these Terms and Conditions.

Dispute

9. If You have registered for a Short Course or Micro-credential as an individual, any dispute between us shall be resolved through the Grievance Procedures prescribed in the Massey University Calendar.

10. If You have registered for a Short Course or Micro-credential as part of a sponsored group, any dispute between us shall be resolved through a separate agreement between Massey University and the sponsor which stipulates how disputes will be resolved.

Privacy

11. Massey University will collect, store, use and disclose personal information about You in the course of conducting its business. A unique identifier may be assigned to You to facilitate this. You have read and understand how such information will be managed and disclosed in accordance with the Privacy Act 2020, and as outlined on the University privacy web page and in the University Calendar. You acknowledge that You have the right to access and seek correction of personal information about You and understand that if You withhold information or provide false or misleading information Your registration in the Short Course or Micro-credential may be terminated. You authorise the use of Your information (including photographs) for purposes related to Your study and for the provision and improvement of services for learners and potential learners of Massey University.
