A Contractual Framework for Two-Stage Early-Contractor Involvement (2S-ECI) in New Zealand Commercial Construction Projects

Construction projects are often fully designed before construction companies are invited to competitively tender a bid for the works. This creates problems because construction companies have little opportunity to provide design buildability advice and often a short timeframe to plan the project. There is a growing trend to instead employ construction companies during the design stage to collaboratively plan and de-risk projects. Mr Finnie evaluated the optimal contract provisions for employing contractors through two-stage early contractor involvement (2S-ECI) through interviews, survey, and evaluation of contractual obligations. Findings suggest that (2S-ECI) is best suited to projects involving alterations to existing buildings where the client's operations are continuing during the works. As a practical output, Mr Finnie drafted a pre-construction services agreement based on the findings, for use in industry.
